What a novel concept! They're actually in a courtroom! I know in the beginning they wanted to avoid a courtroom because they were trying to separate themselves from JAG. But it's been 15 years. I'd love to see an episode where the characters have to testify in a trial. I don't know that I see that happening in this episode but at least this is something new.

Frank and George are doing a bang up job in their 1st "their ideas" season.

So the Federal public defender calls Ducky the best of the best. Gotta wonder if it's flattery or really what she's been told. About zero chance it will actually happen, but I'd love it if the "second string" ME turned out to be Dr. Diggar Aldridge.

I think it's rather convenient that the NCIS agent that was lead on the case not only wasn't our Team Gibbs but he's also dead and can't defend himself.

Well, they were probably looking for something new to do, but forgot to watch season 2's 'SWAK'.

COLD/TEASER:
Gabriel Hicks - the man who got convicted of murdering a Lt O'Connell - 10 yrs ago. Framed by NCIS.
The Bullpen Banter. If Nick DOES self-pedicures I hope Mani-McGee doesn't give him a hard time.
Current NCIS agents are off the hook. NCIS agent in charge is dead. FBI agent Fornell on the FBI side.
10 years ago Jimmy would still have been there but was he at work to assist the fill-in ME?
Big miss by the temp guy - swinger of the killer blow with a pipe was a lefty. Hicks is right handed (but could he be ambidextrous?).
ACT 1:
More banter in the bullpen - Nick begins his campaign to drive Ellie crazy, says "Jack" told him something [profiling her] that made his day.
Hicks looks guilty.
Missing a minute or two for VA election results.
Fornell with Gibbs at diner proclaiming Hicks guilt. Trouble ahead.
Scene of the crime. Torres bullying Ellie because it's fun. Jack said nothing about her.
Really? That license was really there for 10 years? Sloppy work by the team doing the initial work. Placed there recently is my guess.
When was the last "Blood Smear" killing? Looking up for Hicks.
ACT 2:
The last serial killer case Gibbs & Fornell worked on was "how did the toe end up in her husband's stomach?" one.
Fornell too resistant to reopening the case.
Per Ducky: Anti-social personality. Was Hicks?
Gibbs still has the "scratch" beneath his eye. Very feint now.
Nick stops Tim from telling Ellie the truth.
Major MassSpec to the rescue. Only one fruit store of 3 was in business 11 years ago. Nick off to talk with them.
Gabriel Hicks a bit too calm.
What does Gibbs think? What does Jack think?
Owner remembers the bags. Employee would know too - makes run for it. Nick takes down.
ACT 3:
Interrogation. Nick. Aunt of employee was the "Fruit Lady".
I like the realistic "buzzzzzz" of the lights in the interrogation room.
Where is Auntie? I'm guessing dead. Nephew has been cashing her annuity checks.
Thank you, Tim. He's one of the good guys.
Court. Loved seeing a courtroom again. Prosecutor's "testimony" needs to be stricken from the record.
Ellie calls Fornell with name of Mary Smith. Not dead after all. Gibbs goes to see her. She remembers that day. Man in blue van was black and in his 40s. She told - wait for it - Fornell.
Alone with Gibbs Fornell sticks to his "gut". Says Mary is lying.
I hope Fornell is right for his sake but ... ... calls Gibbs a hypocrite (and he is) because G has played judge, jury, executioner. Kicks his old frenemy out of his house.
I doubt if they'll "go there" but man it would make for awesome TV.
ACT 4:
Well Gibbs, it's not that you have nothing, it's that you don't like what you're being told.
Gibbs lying to Hicks' lawyer. She's putting him on the stand.
Gibbs! Is! Wrong!
Jack has ethics!
Rock and a hard place.
I love the card catalogue in Jack's office.
Tells story about the cabinet, made by her dad for her mom, it's flawed.
On the stand! He reluctantly tells the truth. He believes Mary Smith. Tells the truth that she told Fornell 11 years ago.
Fornell tipped off Hicks lawyer about Mary Smith.
Wow! They did go there.
Vanilla turned to chocolate.
Batting practice. Oh boy! He IS ambidextrous.
Jack: He played us. Gibbs: Game's not over. Does this mean the case will be coming back to exonerate Fornell? (Even though he DID know Mary gave description of black man in his 40s back then)

I write and eat left handed, but I throw, swing a bat and an axe right handed. (I can also swing the bat and axe left handed, just can't throw left handed)
I knew that had no bearing on the murder when Palmer and Ducky made the observation.
What a convoluted episode. Nick being childish, picking up where Quinn left off picking on Bishop, No Gibbs in the lab, this was poorly conceived, executed, and presented. Major step down from previous episodes. And that's saying a lot since the previous two weren't that good either.

I thought it was a pretty well done episode even though I suspected from the beginning he wasn't really innocent. So far I'm liking this season very much.
